These Terms and Conditions ("Terms") govern your access to and use of goScribble (the "Service"), including our website, game rooms, and related features.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms on your behalf.

You represent that you have the legal capacity to enter into these Terms and that your use of the Service complies with applicable laws.

goScribble is a free, browser-based multiplayer party game in which players take turns drawing a word while others try to guess it. The Service may include real-time drawing, chat or guess messages, scoreboards, private rooms, and word lists in multiple languages.

The Service may also include present or future paid, advertising-supported, or otherwise monetised goScribble modes, including Replay Mode, in which selected drawings are replayed without identifying or crediting the drawer, and marketing or promotion of goScribble.

We may add, change, or remove features at any time. We do not guarantee that any particular feature will remain available.

The Service is provided for casual entertainment among friends, families, classrooms, and teams. It is not intended for high-stakes, commercial gambling, or mission-critical use.

You can use much of the Service without creating an account. You may choose a display name and avatar when joining a room. Names and preferences may be stored locally on your device.

You are responsible for the information you choose to share in a room. Because rooms can be joined via link, anyone with the link may be able to see your display name, drawings, and messages sent during that session.

The core game is currently offered free of charge. We reserve the right to introduce optional paid features in the future. If we do, we will present applicable terms before you are charged.

You are responsible for any internet access, data, or device costs associated with your use of the Service.

You agree to use the Service lawfully and respectfully. You will not use the Service to harass, threaten, abuse, impersonate, or harm others.

When drawing, chatting, or guessing, you will not post content that is illegal, hateful, sexually explicit, excessively violent, or otherwise inappropriate for a casual game setting.

You will not attempt to cheat, disrupt games, overload our systems, scrape the Service, reverse engineer it except where permitted by law, or interfere with other players' enjoyment.

We may remove access to rooms or the Service for conduct we reasonably believe violates these Terms or creates risk for other users or for us.

"User Content" means content you submit through the Service, including drawings, guesses, display names, and messages.

You retain any rights you may have in your User Content. You are solely responsible for it and for ensuring you have all rights needed to submit it.

By submitting a drawing, you grant goScribble a non-exclusive, worldwide, royalty-free licence to collect, retain, reproduce, copy, technically adapt or format, moderate, edit, replay, display, distribute, and make the drawing available through goScribble. This licence covers operating, improving, securing, and moderating the Service; present and future paid, advertising-supported, or otherwise monetised goScribble modes, including Replay Mode; and marketing or promotion of goScribble. It does not authorise us to sell the drawing dataset, license it to unrelated third parties, or use drawings for AI or machine-learning training.

Our infrastructure providers and contractors may process drawings on our behalf where needed to provide, secure, maintain, moderate, or promote the Service.

Active rooms and their live room state are temporary. Separately, we may select drawings for a retained Replay library. Selected Replay Drawings may be stored and used without identifying or crediting the drawer and without royalties, compensation, or approval for each use.

The licence for a selected Replay Drawing survives the drawer leaving or stopping use of the Service and continues for as long as we retain and use that Replay Drawing, subject always to non-waivable legal and privacy rights.

We may reject, exclude, edit, or remove drawings that contain personal information, names or signatures, prohibited material, or content that appears to infringe another person's intellectual-property rights.

The Service, including its software, design, branding, logos, and word lists we provide, is owned by or licensed to goScribble and is protected by intellectual property laws.

Except for the limited right to use the Service as permitted by these Terms, no rights are granted to you. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

The Service may rely on third-party infrastructure or link to third-party sites. We are not responsible for third-party services, content, or policies.

Your use of third-party services is at your own risk and subject to their terms.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that drawings, guesses, or scores will be accurate or preserved.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOSCRIBBLE AND ITS OPERATORS, CONTRIBUTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

To the extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim, or (b) fifty US dollars (USD $50).

Some jurisdictions do not allow limitations of liability, so the above may not fully apply to you.

You agree to defend, indemnify, and hold harmless goScribble and its operators from and against claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.

You may stop using the Service at any time. We may suspend or terminate access to the Service, or remove content, if we reasonably believe you have violated these Terms, created risk or legal exposure, or if we discontinue the Service.

Sections that by their nature should survive termination will survive, including the licence for selected Replay Drawings, intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and give prominent notice before a material change to drawing retention or use takes effect.

These updated Terms take effect on 10 August 2026. The drawing licence in this version applies only to drawings submitted on or after that date. Continued use of the Service after that point constitutes acceptance of the updated Terms. If you do not agree, do not submit drawings and stop using the Service.

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules.

If a dispute arises, we encourage you to contact us first so we can try to resolve it informally. Subject to any mandatory rights you may have under the laws of your country of residence, the courts of England and Wales will have exclusive jurisdiction over any dispute that cannot be resolved informally.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision is not a waiver of our right to do so later.

These Terms constitute the entire agreement between you and goScribble regarding the Service and supersede prior agreements on that subject.
